Trendspurt GmbH and its subsidiaries and affiliates respect your privacy and are committed to protecting it through our compliance with this Policy.

Our Privacy Policy explains how Trendspurt collects, uses, and discloses information about you. The terms “Trendspurt”,“we,” “us,” and “our” include Trendspurt GmbH and our affiliates. We use the terms “you,” and “your” to mean any person using our Platforms xdhero.com, richcontentdesign.com, tourdexd.com, tourdeanimate.com, tourdehype.com and others.

Please read this Privacy Policy carefully. It summarizes the various ways we acquire and treat your Data when you access, visit and/or use the Services.

You can access this Privacy Policy any time in the footer of the Service’s home page. By registering for any aspect of the Service, or otherwise accessing, visiting or using the Service, you consent to this Privacy Policy.

This Privacy Policy may be modified from time to time, so check back often. So that you are aware changes have been made, we will adjust the “Last Revised” date at the beginning of this document. If we make a significant change to your rights or obligations hereunder, we will also post on the Service a prominent notice that a change was made.

1. Collection Of Information

There are three general categories of information we collect.

1.1. Information You Provide to Us

We collect information that you provide directly to us. For example, we collect information that you provide when you create an account or sign up for our Newsletter. The types of information that we may collect include your (user-)name, password, email address and any other information that you choose to provide.

1.2. Information Collected by Cookies and Other Tracking Technologies

We and our service providers collect information using various technologies, including cookies and pixel tags (which are also called clear GIFs, web beacons, or pixels). When you interact with the Services, certain information about your use of the Platforms is automatically collected, regardless of whether you create an account on the Platforms. This information includes, but is not limited to, your browser type; mobile phone, tablet or other device type; computer or mobile operating system; the domain of the website that referred you to us; name of your Internet service provider; web pages you visit on the Services; IP address; geo-location information; and standard server log information. We also collect information about your interactions with our email messages, such as whether the messages were opened and the links clicked in those emails.

Much of this information is collected through cookies, web beacons and other tracking technologies. You can learn more about how we and our service providers use cookies by reading our Cookie Policy in Segment 6 “Tracking and Cookies”.

1.3. Information We Collect From Social Media Services

If you choose to register or log into your account through a third-party social media account (Facebook, Google, Twitter), we will receive information about that account, such as your authentication token from the third-party account, to authorize linking. If you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options.

2. Use Of Information

Legitimate Interests

Under the EU General Data Protection Regulation there is a concept of “legitimate interests” as a justification for processing your Personal Data, where we have good and fair reasons to do so in ways which do not adversely affect your interests and rights.

Our legitimate interests for processing your Personal Data are:

  • To enable you to access and use our Platforms
  • Display information about you at your profile page, for instance, your (user-) name, for editing;
  • Provide, maintain, and improve our Platforms, including develop new products and services;
  • Monitor and analyze usage and activities on our Platforms

3. Storage Of Information

Website Data

We store all Personal Account Data collected via our Platforms on secure servers administered by DigitalOcean LLC., MongoDB Atlas.

DigitalOcean has certified its compliance to the EU-U.S. Data Protection Agreement (“Privacy Shield Framework”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from such countries. For more information on Digital Ocean’s Privacy Shield certification, please see their Privacy Shield Notice. Digital Ocean is committed to GDPR compliance and to help their customers comply with the GDPR when they use their services. They currently utilize Standard Contractual Clauses in connection with transfers of data from the EU-U.S. insofar as the EU-US Privacy Shield is deemed invalidated and other means are not yet in place. MongoDB Atlas has certified its compliance to the EU-U.S. Data Protection Agreement (“Privacy Shield Framework”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from such countries. For more information on Digital Ocean’s Privacy Shield certification, please see their Privacy Shield Notice.

For sending emails, we will forward the email address to Mailgun Technologies. As part of their GDPR compliance, Mailgun offers to process these addresses on secure servers based within the EU.

Mailgun Technologies, Inc. located in San Antonio, Texas has certified its compliance to the EU-U.S. Data Protection Agreement (“Privacy Shield Framework”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal data from such countries. For more information on Mailgun’s Privacy Shield certification, please see their Privacy Shield Notice. In addition to the Privacy Shield as another lawful mechanism to transfer data between the EU and the US, Mailgun maintains EU Standard Contractual Clauses, which forms part of their Data Protection Agreement. The Standard Contractual Clauses are model clauses published by the EU commission and designed to facilitate transfers of personal data from a data exporter located in the EEA and a data importer located outside of the EEA. Third-Party Embeds (YouTube etc.)

Some of the content that you see displayed on our Platforms is not hosted by Trendspurt. These “embeds” are hosted by a third-party and embedded on our Platforms.

For example: Embedded videos. These files send data to the hosted site just as if you were visiting that site directly (for example, when you load a page with a YouTube video embedded in it, YouTube receives data about your activity). Trendspurt does not control what data third parties collect in cases like this, or what they will do with it. So, third-party embeds on our Platforms are not covered by this Privacy Policy. They are covered by the Privacy Policy of the third-party service. For more information, please see Google Privacy Policy.

4. Update Information

If you have created an account on one of our platforms and provided us your email address, we will inform you from time to time (maximum once or twice a month) by email about updates or news of the platform you have signed up for. You are free to unsubscribe anytime by clicking the unsubscribe link you will find in every email. In that case, your email address will be deleted for this update mails and we will no longer send you these kinds of emails. Please regard, your email address is still stored in your Personal Account Data for login unless you delete your whole account.

5. Newsletters

If you have signed up for our Newsletters and provided us your email address, we will use this information to provide you with announcements of new content, updates and other useful tips.

The subscription for our newsletter is voluntary and you are free to unsubscribe anytime by clicking the unsubscribe link you will find in every email. In that case, your email address will be deleted and we will no longer send you these kinds of emails, unless you sign up again.

6. Tracking and Cookies

We and our service providers use cookies and other technologies to provide our Platform and to enhance your experience. By using our Platforms, you consent to storage and access to cookies and other technologies on your device, in accordance with this Cookie Policy.

Cookies

Much of the information is collected through cookies, web beacons and other tracking technologies.

Pixel tags are electronic images that may be used in our Platform or emails, and track usage of our Platform and effectiveness of communications.

Cookies are small data files stored on your hard drive or in device memory that help us improve our Platform and your experience, and track usage of our Platform. Cookies are then sent back to the originating website on each subsequent visit, or to another website that recognizes that cookie. Cookies are useful because they allow us to recognize your device.

Cookies don’t stay around forever and your web browser will eventually delete them. When a website stores a Cookie, it states how long the Cookie should stay on the computer for – this can be for the current visit only or for a period of time, for example one week.

Most web browsers automatically accept cookies but you can choose to modify your browser setting to disable or reject cookies at any time (for help on how to do this, go to www.aboutcookies.org). If you delete your cookies or if you set your browser to decline cookies, some features of the Platforms may not be available, work, or work as designed.

Among the third party cookies used for purposes of optimizing the Services on our Website is:

Google Analytics, a web analytics service provided by Google, Inc. Google Analytics uses cookies or other tracking technologies to help us analyze how users interact with and use the Services, compile reports on the Services’ activity, and provide other services related to our Services’ activity and usage. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a return visitor, and any referring website. The Services do not use Google Analytics to gather information that personally identifies you. The information generated by Google Analytics will be transmitted to and stored by Google and will be subject to Google Privacy Policies. Google AdSense, a targeted advertising service provided by Alphabet, Inc. Google AdSense uses cookies and other tracking technologies to deliver targeted advertisements on third party websites. The technologies used by Google may collect information such as your IP address, time of visit, whether you are a return visitor, and any referring website. The Services do not use Google AdSense to gather information that personally identifies you.The information generated by Google AdSense will be transmitted to and stored by Google and will be subject to Google Privacy Policies.
